£800,000 fine in health & safety prosecution

Richard Heller prosecuted the multi-national logistics giant, Kuehne+Nagel Drinks Logistics Limited (represented by Dominic Kay QC), for a single offence contrary to s.2 of the Health and Safety at Work Etc. Act 1974 following an incident in which an employee suffered life-changing injuries having been struck by a forklift truck whilst carrying out his normal work activities at one of the company’s warehouse facilities. Having been taken by Air Ambulance to hospital, the employee’s legs were saved following emergency surgery. After hearing legal argument as to the correct application of the sentencing guideline, the District Judge accepted that this was a case of high culpability where the company had fallen far short of appropriate standards. Accordingly, the company was fined £800,000.
