Julian Norman gains permission from Upper Tribunal for Judicial Review

R (Azamat Baimurzaev) v SSHD, JR/7819/2015. Julian Norman appeared successfully on this matter concerning interpretation of the Immigration Rules. Further to Julian's successful argument, permission was granted by Upper Tribunal Judge King for judicial review. The issue was whether the calculation in paragraph 245ZX(ha) of the Immigration Rules, which restricts the time a person can spend as a Tier 4 (General) student in the UK, should include time spent residing in the UK but not actually studying, where the reason for the interruption to study was that the Respondent had herself revoked the sponsor licence of the Applicant’s college. More will follow on this case further to the judicial review hearing.
