Richard Heller acts for London Borough in securing record confiscation order

Instructed by Priyani Peruma at the London Borough of Barnet, Richard has recently secured the highest confiscation order made in favour of that authority. At the conclusion of proceedings, which have lasted a number of years, with visits to both the Divisional Court and the Court of Appeal during that time, Saeid Rahmdezfouli was ordered to pay a confiscation order in excess of half a million pounds. He was also fined £65,000 and ordered to pay costs in the sum of £80,000, having been convicted of contravening the terms of a Planning Enforcement Notice in respect of a property he converted into multiple units of accommodation. The trial and confiscation proceedings involved substantial legal argument concerning the complexities of the Town and Country Planning Act 1990 and its relationship to criminal proceedings, with all issues being resolved in favour of the London Borough of Barnet and affirmed by the Court of Appeal.
