Wayne Cleaver successful in Court of Appeal

Wayne Cleaver has successfully responded to an appeal against sentence imposed following a conviction for Murder. The appellant, Whittle, was convicted at Chelmsford in what the Trial Judge described as a callous, brutal and premeditated murder of a vulnerable woman. The Judge imposed a mandatory life sentence with a minimum term of 20 years to be served. The appellant submitted that the 15 years starting point had been wrongly elevated given the absence of statutory aggravating features [CJA 2003, Sch 21, para 10] and that the Judge had taken no account of mitigation. Lady Justice Nicola Davies described the case as so horrendous that the Judge was correct to significantly exceed the recognised starting point. Wayne was instructed by the CPS Central Appeals Unit.
