Case Overview

Ahmed Muen successfully secured unanimous acquittals for the defendant in a highly complex and sensitive rape trial at Southwark Crown Court. The case garnered significant attention due to the serious nature of the allegations and the intricacies involved in the presented evidence.

Charges Faced

The defendant was facing multiple serious charges, which included:

  • Rape: A severe accusation that carries heavy social and legal implications
  • Controlling and coercive behaviour: Accusations of exerting undue influence and control over the complainant
  • Threatening to disclose sexual photographs and videos: Allegations of blackmail or threats involving sensitive and private media
  • Theft: Charges of unlawfully taking property
  • Sexual assault: An additional count of sexually inappropriate behaviour which the jury was unable to decide upon

Defence Strategy

Ahmed orchestrated a meticulous strategy focusing on the credibility and integrity of the evidence presented by the prosecution.  Central to the defence’s argument was the contention that the recorded footage, which was a pivotal piece of evidence, had been manipulated and altered. The defence challenged the authenticity and reliability of the footage, suggesting that it could not be trusted to accurately depict the events in question.

Trial Outcome

The trial, which lasted seven days at Southwark Crown Court, culminated in a favourable outcome for the defence:

  • The jury unanimously acquitted the defendant of the charges of rape, controlling and coercive behaviour, threatening to disclose sexual photographs and videos, and theft.
  • However, the jury was unable to reach a consensus on the additional count of sexual assault.

CPS Decision

Following the trial, and after considering representations made by the defence, the Crown Prosecution Service decided not to pursue a retrial for the unresolved count of sexual assault. This decision marked the end of the legal proceedings against the defendant for these charges.

Ahmed Muen’s successful defence was supported by Ibrahim Hussain of Stonehall Solicitors, who instructed him for the case. Together, their collaborative efforts were instrumental in achieving the acquittals, highlighting their expertise and commitment in handling such a serious and sensitive case.

The outcome of this case highlights the advantages of a well-prepared and strategic defence, especially when involving serious and complex allegations.
