Simon Walters

Simon Walters has been a member of chambers for over a decade and has developed a successful and thriving practice.

Most of Simon’s time is spent prosecuting and defending in the Crown Court. He is committed to providing the highest level of advocacy and advice across the criminal spectrum and generates genuine rapport with professional and lay clients alike.

Simon regularly prosecutes and defends cases involving complex and expert evidence. He is a Grade 3 CPS Prosecutor. Simon also deals with the full range of ancillary applications including Sexual Harm Prevention Orders, Serious Crime Prevention Orders, Criminal Behaviour Orders and confiscation.

When not in the Crown Court, Simon practices in the area of Professional Discipline. Having completed secondments with a large regulator in 2014 and a market-leading solicitor in 2015, Simon returned to chambers and ever since has received regular instructions to act for regulators and practitioners alike.

Notable Murder & Manslaughter cases

HB & Others [2017] Norwich Crown Court

Led junior in the successful prosecution of a defendant who had been trafficked to Norwich from London as part of a county lines operation, but who ended up stabbing to death one of the occupants of the cuckooed premises in which he was based.

Since the advent of the Modern Slavery Act 2015, Simon has regularly acted in cases affected by the law in this ever evolving are of practice.

Most prominently, this has involved prosecuting and defending those involved in county lines operations. However, Simon has also represented teenage defendants who are themselves accused of exploiting other young people known to them from their local area.

R v Moon Swee How [2025] Portsmouth Crown Court

Defending, led by Robert Bryan, the organiser of a brothel prosecuted for trafficking non-vulnerable consenting adult female sex-workers within the United Kingdom. The key legal issues touched on the proper interpretation of section 2 of the Modern Slavery Act 2015 (Human Trafficking), the definition of trafficking and the reading into English statute of Article 4 of the Council of Europe Convention of Action against Trafficking (‘ECAT’ Convention) and associate Palermo Protocol. The rulings are subject of appeal.

R v S [2022] Portsmouth Crown Court

Represented a 17-year-old defendant which multiple previous convictions for Class A drug trafficking, who on this occasion faced the allegation that he had trafficked multiple other young people to sell controlled substances.

R v C [2022] Southampton Crown Court

Prosecuted a female defendant in her early 20s, with previous convictions for Class A drug offences, who alleged that she had been under the control of a violent gang all along, but had never shared this information before.

Prosecuted a defendant alleged to be selling drugs on behalf of a County Line.

Represented a defendant accused of the rape of an unknown female who was on her way home from a night out.

Prosecuting an allegation of kidnap from a nightclub which was sexually motivated.

Prosecuted a gang based in London who were running a county line in Portsmouth.

Prosecuted an OCG running a chop shop which stole keyless vehicles, broke them down for parts and exported them.

R v H [2021] Southampton Crown Court

Represented one member of a large OCG importing and distributing Class A and B drugs.

R v H & Others [2018-2019] Woolwich Crown Court

Led junior and junior alone across four trials prosecuting an OCG smuggling people across the Channel and laundering the proceeds.

R v A [2022] Portsmouth Crown Court

Represented a defendant accused of shooting multiple college students with air weapons.

R v H & Others [2021] Southampton Crown Court

Represented one member of a group of youths who committed an attack on members of the public at night with an air rifle.

R v E [2020] Southampton Crown Court

Allegations of threatening another with a revolver in the course of a drug dispute.

R v H [2019] Chelmsford Crown Court

Prosecution of a Registered Firearms Dealer in relation to the possession of firearms that were not disclosed to the authorities.

Thames Valley Police v S & S [2022] Oxford Magistrates’ Court

Acted for the police in an application for forfeiture of assets linked to money laundering.

Thames Valley Police v G [2021] Hove Crown Court

Acted for the police in a series of joint applications against the owner of a series of companies suspected to have been involved in fraudulent online activity. £0.5m was forfeited, which had been the subject of Account Freezing Orders.

Met Police v H [2021] Wimbledon Magistrates’ Court

Represented the Met in an application for the civil recovery of assets owned by an individual.

Notable Criminal Fraud cases

R v Willis-Chambers [2024] Portsmouth Crown Court

Led by Robert Bryan on behalf of the defence. We secured a stand-out result for an alleged rogue builder in a Trading Standards Fraudulent Trading prosecution. Using 4 business entities over a period of 4 years the Defendant earned in excess of £1.3 million. Following a trial lasting 10 weeks the Jury convicted of a single allegation valued at approximately £38,000. The Judge as persuaded that an immediate sentence of imprisonment was unnecessary leading to a suspended sentence being passed.

R v S [2022] Portsmouth Crown Court

Prosecuted an individual who forged documentation to obtain finance for his businesses which were failing as a result of the pandemic.

Simon has developed an extensive practice in regulatory and professional disciplinary law and accepts instructions on behalf of regulatory authorities and professionals. He has appeared before fitness to practise tribunals of different regulators in every conceivable type of hearing and is able to advise on all relevant issues both pre- and post- hearing.

Simon has appeared at the General Medical Council, General Optical Council, Nursing and Midwifery Council, Health and Care Professions Council and the Association of Chartered Certified Accountants, amongst other regulators. The cases in which he has appeared include those concerning patient deaths, allegations of harassment and sexual assault and dishonesty, as well as those raising lack of competence and health issues.

Notable Professional Discipline cases

NMC v B [2022]

Defended a Senior Nurse accused of dragging a patient to a bathroom, stripping him naked and washing him, all against his will. The nurse was alleged to have caused physical harm to the patient in question.

ACCA v C [2022]

Prosecuted an Accountant who forged a document on behalf of a colleague to obtain a large personal loan in order to stave off bankruptcy and, once having been made bankrupt, transferred her ownership of two companies to another in an attempt to prefer creditors.

GOC v G [2021]

Prosecuted an Optician who was alleged to have inappropriately touched a child patient during an examination.

BCA v CQC [2021]

Acted for the Care Quality Commission before the High Court First Tier Tribunal in an appeal by a domiciliary care agency to cancel its registration in the light of multiple failures.

HCPC v S [2021]

Prosecuted a Paramedic who stole Class A drugs from her employer over approximately a 12-month period. The Class A drugs were for personal use.

NMC v V [2021]

Defended a Nurse who was alleged to have dishonestly forged multiple documents as part of her revalidation process.

NMC v R [2021]

Defended a Nurse who was alleged to have self-prescribed multiple medications, including controlled drugs.

HCPC v M [2021]

Prosecuted a Paramedic for allegations of verbal, physical and sexual abuse of a colleague.

NMC v P [2021]

Represented a Nurse who was alleged to have falsified documentation as part of her revalidation process. This allegation arose in the context of bullying and finger pointing among prison staff, following multiple prisoner deaths.

HCPC v L [2021]

Prosecuted a Biomedical Scientist who placed patients at risk of serious harm by falsely reporting lab results.
