Giles Fleming is an established and well-regarded criminal barrister, with a practice of increasingly serious and complex cases.

Whether prosecuting or defending, Giles seeks to provide realistic and actionable advice from an early stage, delivered in a way that is easily understandable to lay clients. He is a CPS Grade 3 panel advocate, and a member of the SFO C panel.

Giles has been instructed alone in a range of serious cases including people-trafficking, serious violence, paper-heavy conspiracies, and rape and serious sexual offences. Cases in which he has been led have included allegations of murder, modern slavery, organised money laundering, and multi-complainant historic sexual abuse.

Giles has in depth experience of complex white collar crime offences, having been instructed for several years as part of the team representing a global natural resources company facing a possible SFO prosecution for corruption offences. When instructed alone, he has represented defendants accused of high-value frauds, including successfully defending a client accused of conspiracy to commit a £270,000 romance fraud.

R v H [Ongoing]

Led by Allison Summers K.C. Representing client charged with “missing body” murder.


R v H & Others [2025-6]

Led by William Carter. Defence of client accused of murder as part of a rivalry between drugs lines. Complex disclosure issues regarding main prosecution witness, who disappeared for a week during his evidence.


R v D [2025]

Led by Andrew Jackson. Prosecution of murder in a domestic context. Successfully argued against defence silk for the court to admit confession evidence given by a prison officer.


R v B & Others [2023]

Led by Joanna Hardy-Susskind. Representing first defendant in a trial of alleged double attempted murder. Both the alleged victims, and the defendant, were under 18 at the relevant time.


R v F & D [2022]

Led by Andrew Jackson. Prosecution of a murder case. Stabbing arising out of a feud between rival drug dealers.

Giles has taken a keen interest in Modern Slavery offences throughout his career, working during pupillage on the leading case of R v Joseph & Others [2017] EWCA Crim 36 on the defences available to victims of human trafficking; and as a result also assisted in the preparation of the practitioner text Human Trafficking and Modern Slavery: Law and Practice (Southwell, Brewer and Douglas-Jones), focussing in that context on the prosecution of the perpetrators of slavery and trafficking offences. Since then, he has prosecuted and defended in cases both involving the use of the s.45 Modern Slavery Act defence, and where offences under sections 1 & 2 of the Act have been charged.

Notable Modern Slavery cases


R v R & Others [2025]

Representing first defendant on an indictment charging human trafficking and forced labour, as well as drugs offences. Crown eventually persuaded not to pursue the modern slavery offences.


R v R [2024]

Led by Ben Douglas-Jones KC. Successfully resisting appeal of one defendant after her conviction in a multi-handed money laundering case, who sought to argue that the s.45 Modern Slavery Act defence should have been left to the jury.


R v B, H, R-M & W [2022]

Led by Stephen Mather. Prosecution of conspiracy to traffic a 16-year-old boy from London to Huntingdon, and to coerce him into involvement with the supply of cocaine and heroin.

Notable Sexual Offences cases


R v B [2025]

Defendant charged with assault by penetration and other sexual offences committed against a vulnerable young complainant. Also allegations of threats to kill same complainant, possessing a prohibited firearm allegedly used to reinforce demands, and of supplying her with drugs.


R v M [2024]

Defence of client accused of assault by penetration. Successful s.41 argument to adduce evidence of complainant’s recent sexual activity with another, as grounds for a possible false allegation.


R v A [2024]

Defendant charged with a campaign of domestic rape, accompanied by violence. Acquitted on all counts.


R v B [2024]

Defendant charged with assault by penetration of his 12-year-old step-daughter.


Notable Historic Sexual Offences cases


R v D [2025]

Led by Claire Matthews for the prosecution. Trial of a range of sexual offending committed against 8 complainants, all but one of whom were children at the time. Most offending was within Nepalese community, in which defendant was highly regarded because of his caste. The prosecution case was that he abused that position to enable the offending, which had to be sensitively advanced.


R v G [2025]

Led by Claire Howell. Prosecution of schoolteacher for sexual offences in the 1970s and 1980s against a total of 14 complainants, most of whom were former pupils. One complainant had passed away several years before the trial, and unusual issues of hearsay and disclosure arose in relation to him.


R v S [2020]

Led by Claire Howell. Prosecuted a defendant convicted of sexual abuse of 4 different complainants, all of whom were children at the time, over a period of 4 decades.

Giles has worked on a wide range of cases involving different aspects of organised crime, from the trafficking of people into the UK to high-value drug supply, and from organised fraud conspiracy to serious gang-related violence.

He is particularly adept at assessing and deploying detail-heavy evidential material, including complex phone and cell site evidence, and lengthy financial records.

R v K [Ongoing]

Defence of client charged in 18-handed conspiracy to rob mobile phone shops. Prosecution allege that 22 premises targeted across the South East of England. Upwards of 20,000 pages of prosecution evidence.


R v H, R, M, M, M & B [2023]

Led by Charles Myatt. Prosecution of money laundering ring linked to eastern Balkan OCG, the criminal money (over £300,000) appearing to derive from drug supply.


R v C, F & M [2022]

Led by Stephen Mather in prosecution of conspiracy to supply wholesale quantities of cocaine, investigated by the NCA.


R v H-B & L [2021]

Prosecution of two defendants responsible for smuggling a group of Albanian nationals to the UK on board a sailing yacht, most of whom subsequently reported that they had been trafficked.


R v M [2021]

Represented defendant in a gang-related stabbing. The client’s guilty plea amounted to his second conviction for a s.18 offence. Despite this, and despite the Crown arguing that this was a 1A offence on the guidelines (starting point 12 years), a sentence of less than 7 years was achieved, thereby also securing more favourable release provisions.


R v K [2019]

Represented the first defendant in a multi-handed trial for conspiracy to commit fraud, arising out of a “romance” fraud in which the two identified victims had lost more than £270,000 over the course of several months. Acquittal on a submission of no case to answer.

Notable Firearms cases


R v B [2025]

Defended a client charged with a range of offences including possessing a prohibited firearm. Cross-examination of prosecution expert led to jury accepting that the item in question was not in fact prohibited.

Giles’ long-running instruction as part of the team representing a global natural resources company concerns a possible prosecution by the SFO for corruption offences. A key consideration has been the possible route or routes by which corporate liability might be found, from traditional principles of identification of the company with a directing mind and will, to the more recent legislative technique of imposing strict liability with a tightly-limited defence (such as in the Bribery Act 2010).

Giles has in depth experience of complex white collar crime offences, having been instructed for several years as part of the team representing a global natural resources company facing a possible SFO prosecution for corruption offences. When instructed alone, he has represented defendants accused of high-value frauds, including successfully defending a client accused of conspiracy to commit a £270,000 romance fraud.

He is particularly adept at assessing and deploying detail-heavy evidential material, including financial records and extensive historic correspondence. He is familiar with document management platforms for large projects, and has the ability to identify details and patterns within extensive datasets of that kind.

During pupillage, he worked with the team prosecuting the LIBOR and EURIBOR litigation.

Defending a client in relation to a multi-year conspiracy to commit fraud against a major high street retailer.


Re: E [2018-2023]

Instructed as part of the team representing a global natural resources company facing a possible SFO prosecution for corruption offences. Topics on which Giles worked included abuse of process arguments linked to potential SFO misconduct; the “adequate procedures” defence under s.7 of the Bribery Act; planning of witness interviews; and assessing related civil litigation.


R v D [2023]

Representing a defendant charged with an alleged £144,000 fraud over an 8-year period. Discussions with the prosecution led to an acceptance of a lesser date range, and a commitment not to pursue confiscation proceedings.


R v K [2019]

Represented the first defendant in a multi-handed trial for conspiracy to commit fraud, arising out of a “romance” fraud in which the two identified victims had lost more than £270,000 over the course of several months. Acquittal on a submission of no case to answer.
