Richard Davies

Richard Davies joined chambers in 2016. He accepts instructions in the fields of criminal law and regulatory law.

Prior to joining chambers, Richard studied in Maastricht as part of the Erasmus programme. He also worked in-house at a law firm in Vienna, Austria. He specialised in litigation and arbitration. His litigation work focused on cross-border disputes between Austrian entities and foreign companies as well as cases with associated white-collar crime proceedings. His arbitration experience has involved commercial, investment and sports law cases in both institutional and ad-hoc forums.

Richard has developed a broad criminal law and regulatory law practice. He is regularly instructed in crown court cases. He has dealt previously with matters, as defence trial counsel, for allegations such as inter alia murder (as a led junior), rape, sexual activity with a child, sexual assault, robbery, conspiracy to burgle, fraud, money laundering, conspiracy to supply drugs, as well as Section 18 and 20 GBH. He has acted as a led junior counsel and junior alone counsel. He has also obtained several certificates for counsel for youth court matters.

He prosecutes regulatory matters for local councils. He has also undertaken drafting and review work for the Financial Conduct Authority and the Home Office. He is direct access and CPS grade two qualified. In addition, he is approved onto the list of specialist regulatory advocates, Panel C, by the Health & Safety Executive. He has previously undertaken pro bono work for various charities relating to social security appeals, children’s rights and mental health law.

Expertise

Richard has acted, as a led junior counsel, in several murder cases dealing with issues such as mental health conditions, forensics and cell site evidence.

Notable Murder & Manslaughter cases

R v DW – Oxford CC

Defendant found not guilty of murder by reason of insanity. The case involved the killing of the defendant’s mother and extensive psychiatric evidence.

R v AM – Newport CC

Successful application to dismiss for murder and GBH counts against the defendant. This case involved numerous defendants and alleged organised crime related to a cannabis factory.

Richard has completed the vulnerable witnesses training within the Inn of Court. He is familiar with the Ground Rules Hearing and Section 28 procedure. Richard is experienced in the field of appropriate questioning for witnesses of a certain age as well as those with special needs.

Notable Sexual Offences cases

R v KC - Oxford CC

Autistic defendant acquitted of one count of sexual assault against a co-worker. Intermediary used to assist the defendant.

R v SG - Lincoln CC

Defendant acquitted on two counts of sexual assault and indecent exposure. Numerous Section 41, YJCE Act issues involved in the case.

Richard is conscious of the need for rigorous examination of previous accounts given of incidents. He is familiar with the disclosure process for materials such as counselling and social services records. Richard is well aware of the appropriate judicial directions for such matters.

Notable Historic Sexual Offences cases

R v RO - Oxford CC

Successful defence of a man with learning difficulties charged with 15 counts of rape and serious sexual offences. Jury returned unanimous not guilty verdicts on all counts.

Richard is familiar with detailed evaluation of communication evidence in such cases. He is well versed in communicating with vulnerable defendants. Richard has analysed PACE and the police’s obligations therein.

Notable Gangs & Organised Crime Groups cases

R v JB – Wood Green CC

Successful Section 78, PACE argument on the first day of a robbery trial to exclude the ID evidence in this alleged group robbery case. The crown subsequently offered no evidence.

Richard has experience of the evaluation of banking evidence. He has analysed the appropriate sentencing guidelines. Richard is aware of the different type of roles that individuals can allegedly hold in money laundering operations.

Notable Money Laundering cases

R v JC - Snaresbrook CC

Successful defence of a woman in a case which involved six defendants. The case focussed on two groups who were alleged to have conspired to supply Class A drugs. Allegations were made that the lay client transferred thousands of pounds which were alleged to be proceeds of the drug trade. The trial included police surveillance, forensics and over 60,000 pages of telephone evidence. The jury deliberated for two days before returning a unanimous not guilty verdict.

Richard regularly prosecutes matters for local authorities. He is familiar with the appropriate legislation for property licensing and maintenance issues. He has provided advice on the obtaining and presentation of evidence. Richard has given guidance on disclosure issues.
