Prosecution offers no evidence in GBH stabbing case. Lidia Iancu represented the defendant

Background and charges

Lidia Iancu’s client retains his good character after the Crown offer no evidence in relation to charges of inflicting grievous bodily harm following a stabbing. The defendant had previously pleaded guilty to unlawfully and maliciously inflicting grievous bodily harm without intent. He submitted two bases of plea, having been represented by two different firms of solicitors.

Change of representation and application to vacate plea

Peter Fallen, of Edward Fail Bradshaw & Waterson, the third firm of solicitors to represent the defendant, applied to vacate the defendant’s guilty plea and instructed Lidia Iancu.

Court hearing and judicial observations

The case was listed for the application to vacate the plea. The Crown presented written and oral submissions objecting to the defence application. At the start of the hearing, the Court made strong observations against the prospects of the application. After hearing submissions, the Court granted the application. It then made forceful observations to the Crown about reviewing the case.

Outcome

The Crown only changed their position after further review and service of the defence statement. The matter concluded with the Crown offering no evidence.
