Anisa Kebbati’s client acquitted of charges involving a bladed article

Charges and allegations

Anisa Kebbati, instructed by Esra Yildirim of Morgan Has Solicitors, represented a man charged with threatening another with a bladed article, possession of a bladed article, and two counts of battery involving separate complainants. The first complainant alleged that the defendant attacked him without provocation and later threatened him with a large kebab knife, which he said made contact with him. The second complainant alleged that he was also assaulted during the same incident.

Prosecution and defence evidence

The prosecution relied on short CCTV clips and phone footage showing the defendant holding a large kebab knife and walking towards the first complainant. The defence case was that the defendant had acted in self-defence and in defence of his brother. To support that case, the defence produced fuller CCTV footage showing the entire incident and instructed a psychiatric expert, who diagnosed the defendant with Post-Traumatic Stress Disorder. The expert concluded that during the incident he was likely suffering from PTSD related symptoms.

Trial proceedings and verdict

At the close of the prosecution case, no evidence was offered on the charge of possession of a bladed article, and the jury returned a not guilty verdict on that count. Anisa Kebbati cross-examined both complainants, a civilian witness, and two police officers, and also called the defendant and his brother to give evidence.

Following a 6-day trial at Winchester Crown Court, the jury unanimously acquitted the defendant of the most serious charge and battery. He was therefore only convicted of one count of battery.

Sentence and significance

Had the defendant been convicted of the most serious offence, he would have faced a starting point of a lengthy custodial sentence. Instead, he was sentenced to a 12-month community order. The outcome therefore avoided a substantial prison sentence and marked a significant success for the defence.
