Following a 26-day trial at Northampton Crown Court involving six defendants, Stephen Donnelly and Christopher Jeyes achieved acquittals for their respective clients. The case centred around serious allegations relating to a kidnapping incident.
Stephen Donnelly’s client faced a charge of conspiracy to kidnap, while Christopher Jeyes’ client was accused of assisting an offender – namely, the principal party alleged to have carried out the kidnapping. The prosecution’s case revolved around a self-confessed Class A drug dealer who claimed he had been abducted in Northamptonshire due to drug-related debts. According to the Crown, the alleged victim was taken to Lincolnshire, where he was pistol-whipped and beaten, whilst being transported between various isolated locations.
A key issue for the prosecution was the lack of cooperation from the alleged victim. Beyond providing an initial account to the police, he refused to engage further in the case. As a result, the Crown relied on hearsay evidence and res gestae applications in order to present its case. This reliance presented significant hurdles, particularly in a case where credibility and corroboration were crucial.
Stephen was instructed by Dawn Hewitt of CDA Solicitors, and Christopher was instructed by Rebecca Freitas, Ringrose Law. Preparation by both defence teams included meticulous analysis of large quantities of telephone data and the corresponding cell site evidence – evidence upon which the prosecution had relied. Their diligent analysis and robust challenge to the Crown’s interpretation of the data played a critical role in undermining the prosecution’s case. Ultimately, both clients were found not guilty, marking a decisive outcome in this trial.
